General conditions of sale
PREAMBLE
The present general conditions of sale apply between Morocco-inside, association declared by Act of July 1, 1901 and Decree of August 16, 1901.
Hereinafter referred to as «Association»
And
Any person making a purchase via the site internet www.maroc-inside.fr
Hereinafter referred to as the buyer.
These conditions aim to define the terms of sale to distance between the Association and the buyer of the order for payment and delivery.
They regulate all the steps necessary to the placing of the order and track this order between the contracting parties.
The execution of a command on the website www.maroc-inside.fr by the buyer implies acceptance without reserve the provisions of these terms and conditions.
The buyer declares to be at least 18 years of age and have the legal capacity or have parental permission to place an order on the website.
ARTICLE 1: COMPLIANCE AND AVAILABILITY OF PRODUCTS
The products offered for sale by the Association are those listed on the website on the day of the consultation of the website by the buyer.
The products are offered for sale within the limit of stocks available.
Error on the availability of a product ordered, the Association informs the purchaser by e-mail as soon as possible. The buyer will be able to replace the product with another quality and equivalent price or to cancel the order.
The products offered for sale are rigorously selected and imported from the Morocco. There are described and presented with the greatest possible accuracy on the website of the Association. In case of manufacturing defect, nonconformity of the products, error or omission in their presentation on the site the liability of the Association could be held liable. The photographs and texts illustrating the products have only an indicative value and do not enter the contractual field.
ARTICLE 2: PRICE
The prices displayed on the website are indicated in euros inclusive of all taxes, including VAT, excluding participation in shipping costs and order processing costs.
If the VAT rate should be modified, these changes could be passed on to the prices of items without affecting the user about previously.
ARTICLE 3: PAYMENT (SECURE PAYMENT)
The payment of the order is by credit card, by cheque or bank transfer.
To regard the credit card payment online, only cards with the "CB" logo, cards bearing the mark 'VISA', 'EUROCARD' or 'MASTERCARD' accepted in France, or even cards issued within the framework of international networks, approved by the Group of interest economic (GIE) Cartes Bancaires are accepted.
The validation of the order by using the number of the credit card and expiration date is worth mandate to pay the price of said order.
The Association uses the secure Paypal service.
Confidential data by the means of payment are not accessible by the Association, but managed directly by the security service.
The amount of the order is debited at the time of shipment of the products.
Regarding the payment by cheque, it will be issued in euros by a bank domiciled in France. The cashing of the cheque is made at the reception of the latter.
The buyer shall be amended agenda Association Morocco-inside and send it to the following address: 38 bd of Americans - 44300 Nantes.
In the event of payment by cheque, the order will be processed only on receipt of it.
ARTICLE 4: ORDER
Any order worth express and irrevocable acceptance by the buyer, the prices and descriptions of products available for sale, as well as of the present conditions.
After validation of the order, the Association address to the purchaser a confirmation email to the email indicated during the command.
ARTICLE 5: DELIVERY
The ordered products are sent to the delivery address indicated by the buyer during the passage of the control.
TTC means participation in logistical preparation and shipping expenses. All deliveries are announced via e-mail.
For products in stock, the maximum delivery time is 5 days from the order of the product on the website.
In the event of delay in the delivery of more than seven days, if it is not of a force majeure, the buyer has the possibility to cancel his order.
It will follow the refund of the order within 7 days.
SECTION 6: AVAILABILITY
In case of unavailability of the ordered product, the Association shall inform the buyer by sending an email to the email indicated when ordering.
Buyer shall have the right either to be delivered of a product quality and equivalent price, within the limit of stocks available, or to be paid the price of the order within thirty days of the payment of the order.
Delivery of the new product costs are borne by the Association.
ARTICLE 7: RIGHT OF WITHDRAWAL
The buyer has a period of seven days as from the reception of the products or from the acceptance of the offer for the supply of services, to exercise its right of withdrawal without having to justify motives or to pay of penalties, with the exception, where appropriate, the cost of return.
If the period of seven days to expire a Saturday, a Sunday or a public holiday, it is extended until the first following working day.
In case of exercise of the right of withdrawal, the Association shall reimburse the purchaser of all of the amounts paid, as soon as possible and no later than 30 days after the date on which this right has been exercised.
ARTICLE 8: RETURN
From the date of receipt of his order, the buyer has a period of ten days to return a product. After this period, the products delivered shall be deemed compliant and accepted by the client, and the Association reserves the right to refuse the Exchange, credit or refund.
The returned item must be in its original packaging and accompanied by the completed return slip.
ARTICLE 9: WARRANTIES AND RESPONSIBILITY
The Association answers defects of conformity which exists when the product is issued. It has also the defects of conformity resulting from the packaging, mounting or installation instructions (when it was made dependant by the contract or was carried out under his responsibility.)
In the case of a non-compliant product delivery or if delivery of a product revealing a hidden defect, the Association undertakes either to reimburse the buyer of the price of the product, or to exchange the product for another identical according to available stocks, him exchange for product quality and equivalent price according to available stocks.
The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
The action resulting from latent defects must be brought by the buyer within a period of two years from the discovery of the defect.
These provisions are not exclusive of the right of withdrawal defined in article 8 hereof.
Are excluded from warranty the products modified, repaired, integrated or added by the buyer or any other person not authorized by the provider of such product or service.
The warranty will not play for apparent defects.
The warranty will not support products or services damaged during transport or improper use.
The liability of the Association shall not be retained for breach contractual obligations by reason of a fortuitous event or force majeure, as defined by the jurisprudence.
ARTICLE 10: PERSONAL DATA
The Association undertakes to respect the confidentiality of the personal data provided by the buyer on the website and to treat them in accordance with the law Informatique et Libertés of 6 January 1978.
In accordance with the law Informatique et Libertés of 6 January 1978, the purchaser may exercise his right of access to the file, its right of opposition and its right of correction or deletion of the information concerning its request by e-mail to the address contact@maroc-inside.fr or by postal mail at the address 38 Bd of American - 44300 Nantes.
ARTICLE 11: INTELLECTUAL PROPERTY
All elements of the website are protected by copyright, trademarks or patents.
They are the exclusive property of the Association.
ARTICLE 12: APPLICABLE LAW AND COMPETENT COURTS
The present general conditions of sale are executed and interpreted in accordance with the french law.
In case of dispute, the buyer undertakes to contact the Association in priority in an attempt to solve the amicably any dispute likely to intervene between the parties.
The absence of conciliation, the french courts will be only qualified.
ARTICLE 13: AMENDMENTS TO THE GENERAL CONDITIONS OF SALE
The Association reserves the right to adapt or modify at any time the present general conditions of sale. In case of modification, it will be applied to each order the general sales conditions in force on the day of the order.
